Reasons for Rejection are set forth in Patent Law article 49. 

The reasons oftenly notified are as follows.

  • Lack of novelty [Patent Law 29(1)]
  • Lack of inventive-step [Patent Law 29(2)]
  • Lack of novelty due to prior art effect [Patent Law 29-2]
  • Non-satisfaction of enablement requirement
  • Non-satisfaction of requirement of support in specification [Patent Law 36(6)1]
  • Non-satisfaction of requirement of clarity of claims [Patent Law 36(6)2]
  • Non-satisfaction of requirement of brevity of claims [Patent Law 36(6)3]
